By accessing or using the website chicomasonry.com (the "Site") or by requesting, scheduling, or receiving services from Chico Concrete & Masonry ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or our services.
These Terms and Conditions apply to all visitors to the Site and to all customers who engage our services, whether the engagement begins online, by phone, or in person.
Chico Concrete & Masonry provides residential and commercial masonry contracting services, including but not limited to foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, and related work throughout Chico, CA and surrounding communities.
The information on this Site is provided for general informational purposes. Nothing on this Site constitutes a binding offer to perform services. All services are subject to an on-site evaluation and a written estimate accepted by both parties before work begins.
Written estimates are provided after an on-site evaluation of the project. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. Prices are subject to change if the scope of work changes after the estimate is accepted.
Any additional work discovered during a project that was not included in the original estimate will be communicated to the customer before that additional work proceeds. We will not perform out-of-scope work without your written or verbal authorization.
All prices are in U.S. dollars. Sales tax, permit fees, and other applicable charges will be disclosed in the written estimate where applicable.
Project start dates are estimates based on our current schedule, material availability, and weather conditions. We will communicate any delays as promptly as possible.
If you need to cancel or reschedule a confirmed project, please contact us as soon as possible at (530) 399-1739 or hi@chicomasonry.com. Cancellations made with less than 48 hours notice before a scheduled start date may result in a fee to cover mobilization costs, which will be communicated to you at the time of your service agreement.
We reserve the right to reschedule projects due to weather conditions or other factors outside our control. We will not charge cancellation fees for rescheduling caused by weather.
Payment terms will be outlined in your written service agreement. Typical terms require a deposit at the time the estimate is accepted, with the remaining balance due upon project completion. Specific deposit amounts and final payment due dates will be stated in writing before work begins.
We accept payment by check, cash, and electronic transfer. Accepted payment methods will be confirmed in your service agreement. Final payment is due at the time of project completion unless other arrangements have been agreed to in writing.
Overdue balances may be subject to a late fee. We reserve the right to suspend or discontinue work on any project where payments are overdue and where we have provided written notice of the delinquency.
Certain masonry and structural work requires permits from local building authorities. Where permits are required for your project, we will advise you in advance and include any permit fees in the written estimate. We will apply for all required permits on your behalf unless otherwise agreed in writing.
The customer is responsible for providing accurate information about the property, including its jurisdiction, zoning, and any existing permits or easements that may affect the work.
Where a warranty is provided for completed work, the terms, duration, and coverage of that warranty will be stated in your service agreement. Warranties cover defects in workmanship under normal use and conditions. They do not cover damage caused by events outside our control, including but not limited to earthquakes, flooding, soil movement unrelated to our work, vandalism, or modifications made by third parties after project completion.
The information provided on this Site is offered "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Site is at your own risk.
Nothing on this Site constitutes professional engineering advice. For projects requiring structural engineering review, we recommend consulting a licensed engineer.
To the fullest extent permitted by applicable law, Chico Concrete & Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site or our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific service project shall not exceed the total amount paid by the customer for that project. This limitation applies to all claims, regardless of the legal theory on which they are based.
If a dispute arises between you and Chico Concrete & Masonry, we encourage you to contact us first so we can try to resolve it directly. Most concerns can be addressed quickly when we have a chance to talk them through.
If a dispute cannot be resolved informally, you agree to submit the dispute to binding arbitration in Chico, CA, under the rules of the American Arbitration Association. The arbitration will be conducted in English. The arbitrator's decision will be final and binding. Each party will bear its own costs for the arbitration, unless the arbitrator determines otherwise.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration under these terms shall be brought in a court of competent jurisdiction in California.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted to this page with an updated effective date. Your continued use of our Site or services after any changes are posted constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.
